Smith James Declaration Signer James Smith Interesting DSSmith, James, Autograph Document Signed, Narratio, in case of Burney & Hayes v. McBride, Cumberland County Court, Pennsylvania, July Term 1752. 1 p., 7.5" x 12.375". Expected folds; center fold reinforced on verso; small edge tears on folds; some discoloration.Attorney James Smith files a narratio for his clients Thomas Burney and John Hayes explaining that Dennis McBride owed them for £10 worth of goods that they had supplied to him. Because he refused to pay the debt, they sued him for damages of £15.Excerpt: Â"And Whereupon the sd Thomas & John by James Smith their Attorney say that whereas the said Dennis the sixteenth day of March in the year of our Lord one thousand seven hundred & fifty one at Carlisle in the County of Cumberland was indebted unto this Thomas & John in the afsd ten pounds for divers goods wares & merchandizes by them the said Thomas & John to him the sd Dennis & at his special instance & request before that time sold & delivered & so thereof being indebted the sd Dennis in Consideration thereof afterwards to wit the same day year & place afsd upon himself did assume & to the sd Thomas & John then & there faithfully Promise to pay the afsd ten pounds when he should be thereunto afterwards required Nevertheless the sd Dennis thoÂ' oftentimes thereunto required the aforesd sum of money nor any part thereof to the sd Thomas & John hath not paid but the same to them to pay hath refused & still doth refuse to the Damage of the sd Thomas & John fifteen Pounds & thereupon they bring suit &c. Smith ? Quer [Pro Querente; For the plaintiffs]Â"James Smith (1719-1806) was born in Ireland and immigrated with his family to Pennsylvania in 1729. He attended the Philadelphia Academy and studied law in the office of his brother. He gained admission to the bar and practiced near Shippensburg in Cumberland County and later near York in York County. He was appointed to the provincial convention in Philadelphia in 1775 and to the state constitutional convention in 1776. He won election to the Continental Congress and signed the Declaration of Independence.
